Please note : subsection 5 of section 140 - Removal, Resignation of the auditor and giving of special notice ...there is a slight error in my notes - In, Auditor acts fraudulently/colluded in any fraud , the condition - if tribunal is satisfied within 15 days of receipt of application, it shall order that he shall not function as auditor and CG may appoint another auditor. The above condition is only w.r.t application by CG and not by suo moto or by application by any concerned person
