. Mr. Jayanth sells and consigns certain Goods to Mr. Srikanth for cash and sends the Railway Receipt to him. Mr. Srikanth becomes insolvent and while the Goods are in transit, he assigns the Railway Receipt to Mr. Naveen, who does not know that Mr. Srikanth is insolvent. Mr. Jayanth being an Unpaid Seller wants to exercise his rights. Advise whether Mr. Jayanth can exercise the right of stoppage of Goods in transit. Would your answer be different if Mr. Naveen was aware of Mr. Jayanth’s insolvency before the assignment of the Railway Receipt in favour of Mr. Naveen? Can someone pls answer this ??
