Under Section 46 of the Negotiable Instruments Act, 1881, the making, acceptance, or endorsement of a negotiable instrument is completed by delivery. Delivery may be made to the holder himself or to his agent. In this case, Sahdev endorsed the promissory note in favour of Arjun and delivered it to Arjun's agent. Delivery to an authorised agent is deemed to be delivery to the principal (Arjun). The subsequent death of the agent does not invalidate the delivery or Arjun's title to the instrument. Therefore, Arjun became the lawful holder of the promissory note and is entitled to sue Nakul. Conclusion: Arjun can recover ₹10,000 from Nakul, because delivery to Arjun's agent amounts to valid delivery under Section 46 of the Negotiable Instruments Act, 1881. The death of the agent does not affect Arjun's rights as the holder.
