Transactions Resembling Wagering But Not Void Some agreements may look similar to wagers but are not void under the Act. Examples include: 1. Insurance Contracts In insurance, the insured has an insurable interest in the life or property insured. The contract is entered not for speculation, but for protection against loss. 2. Share Market Transactions (Actual Delivery Contracts) Purchase and sale of stocks and shares intending actual delivery and payment are not wagers, even if prices fluctuate—only speculative transactions with no intention of delivery are wagers. 3. Horse Race Competitions with Licensing As per exceptions, certain horse race competition agreements are not void if they are licensed or registered as per law and the prize money is over Rs. 500. 4. Commercial Contingency Contracts Agreements where one party undertakes to pay another depending upon the occurrence of a future uncertain event, but there is a genuine commercial interest (such as shipping contracts), are not wagers.
