Yes, the contract will become void as the acceptance is not communicated in the prescribed way

would it make any difference if the offer is sent through email and acceptance is sent through fax

  3. Vishal · 11 Aug 2024

Here the revocation of acceptance is valid because revocation of acceptance has reached via fax before the email, so revocation is valid but on the other hand if both email and fax would be reached at the same time then acceptance will assume be valid or revocation it depends on the situation that if the fax will be opened first then revocation will be valid if the acceptance will be opened and understand first then revocation would be valid

Revocation of contract is valid as on first case it reached before email In the second case both email and fax reached together ,in this case also revocation of contract is valid If in the second case email is opened first , the revocation of the contract is not valid

In both the mentioned cases the revocation of acceptance would be valid.

Yes the revocation of acceptance is valid And if both of the email and fax reach at the same time then revocation is absolute. There will be no contact.
