The case of Carlill v Carbolic Smoke Ball Company (1893) is a landmark in contract law. The Carbolic Smoke Ball Company advertised that they would pay £100 to anyone who used their smoke ball product and still caught influenza. Mrs. Carlill used the product but still got sick. She sued for the £100. The company argued there was no contract. But as it is a general offer , using smoke ball can be considered as acceptance of the offer . So here company had to pay as they promised in the advertisement and carlill won the case .
