Imagine a scenario where Sarah agrees to sell her vintage car to Alex. They agree on the sale but haven't yet decided on the price. According to Section 10, if either Sarah (the seller) or Alex (the buyer) prevents a third party, let's say a professional appraiser, from determining the price of the car, the party causing the obstruction would be held liable to pay damages to the other party. For instance, if Sarah prevents the appraiser from inspecting the car by failing to provide access or intentionally delaying the process, she would be in default. In this case, Alex, who is not at fault, could claim damages from Sarah for obstructing the price-fixing process. On the other hand, if Alex prevents the appraiser from conducting the inspection, he would be the defaulting party. In this scenario, Sarah, who is not at fault, could claim damages from Alex for obstructing the price-fixing process. In summary, Section 10 ensures that if one party obstructs the determination of the price by preventing a third party, that party is liable to pay damages to the innocent party.
